Human Rights meaning:

  • Human Rights means the rights relating to life liberty equality and dignity of individual guaranteed by the constitution or embodied.
  • Human rights are essentially the rights of people. They are the rights that an individual can avail and enjoy, by virtue of being born as a human being.
    According to Harold Laski “Human rights are those conditions of social life without which no man can seek in general to be himself at his best.”

Characteristic of Human Rights

  1. Universal Application: Human Rights have universal application. All the people have access to human rights, irrespective of caste or sex, religion.
  2. Purpose: The basic Human Rights help not only in protection but also prevention of gross violation of human dignity. Human rights allowed people to develop and use their intrinsic or inborn qualities and talents in order to satisfy their spiritual and material needs.
  3. Condition of Social Life: Human rights are necessary for social life in a society. Without human rights, it is difficult to live a reasonably good life in society.
  4. Minimal Rights: The minimal rights are adequate to give the individual sense of worth and value. Justice Durga Das Basu pointed out that human rights are minimal rights, which every individual must have against the state or other public authority.
  5. Support Human development: With the support of Human Rights, a person can fully be developed and use his qualities and skills to satisfy his/her needs.
  6. Derived from Natural Law: Natural Law can be traced to the thoughts of Sophocles and Aristotle. Natural Law embodied all those elementary principles of justice which were rights rationally, i.e. accordance with nature, unalterable, and eternal.
  7. Independent of the State: Human rights are natural rights. They are not conferred upon individuals by the state.
  8. Origin: Human rights are as old as human Civilization. But human rights, in a more specified and well-defined manner, come with the signing of the Magna Carta in 1215. Magna Carta guaranteed them basic civil and legal rights.

The Universal Declaration of Human Rights (UDHR)

  1. The Universal Declaration of Human Rights (UDHR) was adopted by the United Nation-General Assembly on 10th December 1948 in Paris. The Director of the Division of Human Rights within the United Nation Secretariat, Mr. John Peters Humphrey was the main person to draft the Declaration. There were 48 States favoring the adoption of the declaration and 8 states abstained it.
  2. The preamble of your UDHR consists of seven paragraphs followed by the statement of the proclamation of the declaration. The preamble state the reasons for adoption and declaration:
  • Whereas recognition of the inherited dignity the equal UN in label rights of all members of the human family is the foundation of freedom, justice, and peace in the world.
  • Whereas it is essential, to promote the development of friendly relations between the nation.
  • The equal rights of men and women and have determined to promote social progress and a better standard of living in the largest freedom.
  • Whereas a common understanding of these rights and freedoms is of the greatest importance for the full realization of this pledge.
